Terms & Conditions – Please read these terms of service carefully before using the services offered by Ignite Cycle & Strength

BY VISITING IGNITE CYCLE & STRENGTH’S WEBSITE OR USING ITS SERVICES, YOU AGREE THAT YOU HAVE READ AND AGREE TO BE BOUND BY AND A PARTY TO THE TERMS AND CONDITIONS OF THIS AGREEMENT TO THE EXCLUSION OF ALL OTHER TERMS.  

If you do not unconditionally agree to all terms and conditions, you may not use Ignite Cycle & Strength’s website or services.  If the terms of this Agreement are deemed an offer, acceptance is expressly limited to these terms.

Liability Waiver – Ignite Cycle & Strength is not responsible in any way for the safekeeping of your personal belongings while attending a class. By attending classes, events, activities, and other programs and using the Ignite Cycle & Strength facilities, website, or equipment, you hereby acknowledge on behalf of yourself, your heirs, personal representatives and/or assigns, that there are certain inherent risks and dangers in the strenuous nature of the Ignite Cycle & Strength workout program.

I, the client, acknowledge that I know, understand and appreciate the inherent risks of participating in aerobic and athletic activities. I know that these risks range from minor injuries such as muscle strains and sprains to significant problems such as knee injuries or broken bones to the rare catastrophic events such as heart attacks, paralysis and death. I hereby assert that I am voluntarily participating in the activities and that I fully assume the inherent risks of such participation

I certify that (1) I possess a sufficient degree of physical fitness to participate in aerobics and physical activity; (2) I understand that I am to discontinue activity at any time I feel undue discomfort or stress; and (3) I will indicate below any health concerns that might affect my ability to participate in the activities and I will verbally inform the instructor immediately.

At all times, you shall comply with all stated and customary terms, posted safety signs, rules, and verbal instructions given to you by trainers and staff. In consideration of being allowed to participate in and access the Ignite Cycle & Strength classes and studio facilities, you hereby (1) agree to assume full responsibility for any and all injuries or damage which are sustained or aggravated by you in relation to the Ignite Cycle & Strength classes and studio facilities, (2) release, indemnify, and hold harmless Ignite Cycle & Strength, subsidiary affiliate entities and franchisees, and each of their respective members, employees and representatives and agents, and each of their respective successors and assigns and all others, from any and all responsibility, claims, actions, suits, procedures, costs, expenses, damages, and liabilities to the fullest extent allowed by law arising out of or in any way related to participation in the Ignite Cycle & Strength classes or Ignite Cycle & Strength facilities, and (3) represent that you (a) have no medical or physical condition that would prevent you from properly using any of Ignite Cycle & Strength’s classes and studio facilities, (b) do not have a physical or mental condition that would put you in any physical or medical danger, and (c) have not been instructed by a physician to not participate in physical exercise.

You acknowledge that if you have any chronic disabilities or conditions, you are at risk in participating in Ignite Cycle & Strength classes and use of studio facilities, and should not be participating in any classes.

Note that music will be played at a high volume and songs can contain explicit lyrics.

Customer agrees and acknowledges that various aspects of Ignite Cycle & Strength’s business are protected intellectual property belonging exclusively to Ignite Cycle & Strength. This intellectual property shall include, but not be limited to, the distinctive workout Ignite Cycle & Strength will demonstrate to Customer, the distinctive appearance, layout, stations, and look and feel of the Ignite Cycle & Strength location Customer is invited to view and participate in, as well as any copyrights, trademarks, designs, logos, or trade dress related thereto. As a result, and in further consideration of the services being offered to the Customer by Ignite Cycle & Strength and Ignite Cycle & Strength’s disclosure and demonstration of intellectual property to the Customer, the Customer agrees not to copy, duplicate, photograph, record, reproduce, distribute, republish, perform, display, post, transmit, sell, or make into derivative works or substantially similar works or formats, in any form or by any means, including, but not limited to, electronic, mechanical, photocopying, recording, or otherwise, Ignite Cycle & Strength’s intellectual property without the express, written permission of Ignite Cycle & Strength.

I grant permission for Ignite Cycle & Strength to photograph still images and video of me within the walls of 300-1599 Kenaston BLVD.  I allow Ignite Cycle & Strength to use said images and videos on social media, printed materials and/or commercial production and allow Ignite Cycle & Strength to use these images to promote their business.

I also understand that Ignite Cycle & Strength does not assume any responsibility if photos of you are shared on social media by other gym participants.
